Lots backing to a creek, a drainage easement, or a lake shoreline are common across Rockwall, Heath, Rowlett, Forney, Wylie and Little Elm, and they're governed by rules most homeowners never hear about until a fence gets red-tagged or washed away. Here's the honest picture.
Floodway, Floodplain, and Drainage Easement Are Three Different Things
These get used interchangeably and they carry completely different restrictions.
The floodway is the channel that has to stay clear to carry flood flow. Most North Texas cities prohibit fences in it outright. Frisco's ordinance states plainly that fences are not permitted in floodway areas as designated on FEMA's flood boundary and floodway map, and other cities in the region take similar positions. If part of your lot is in the floodway, that part likely cannot be fenced at all.
The floodplain is the broader area that floods in a major event. Fencing here is generally allowed, but subject to the drainage rule below.
A drainage easement is a recorded strip across your property that the city or a utility has rights to. You typically own the land and can't obstruct it, and anything you build there may be removed without compensation if access is needed.
Your survey, your plat, and the FEMA flood map viewer will tell you which you're dealing with. Most homeowners on these lots have never looked.
The Rule That Actually Decides Your Fence
Outside the floodway, the provision that governs is some version of this: a fence shall not adversely affect drainage or create debris build-up.
That single sentence is why iron works on these lots and wood doesn't.
A solid wood fence across a drainage path is a dam. Water backs up behind it, debris packs against it, and then one of two things happens – the fence fails, or the water goes somewhere it wasn't supposed to go, which is frequently your neighbor's yard or your own foundation. Either way you're out of compliance with the rule and out a fence.
An open-picket iron fence lets water pass between the pickets. Debris still collects at the bottom rail, but it doesn't build a wall, and the fence isn't acting as an obstruction.
Why Wood Keeps Failing on These Lots
Beyond the code question, there's the plain durability math.
Wood on a creek lot sits in periodic standing water. Posts rot at grade. Panels take on water, swell, and rack. The fence catches enough debris in a flow event that hydraulic pressure pushes sections over. Then it gets replaced, and the same thing happens.
Iron doesn't absorb water, doesn't rot, and passes flow. The vulnerability is different – rust at the base and the bottom rail where the metal sits in the wet zone. That's real and it's manageable with proper coating and a design that keeps the bottom rail up off grade. It's a maintenance item, not a replacement cycle.
Lake Lots Are Their Own Problem
Properties on Lake Ray Hubbard, Lake Lavon and Lake Lewisville add two things.
Shoreline jurisdiction. Land below a certain elevation on these lakes is typically controlled by the controlling authority rather than by you, and building anything on it – fence included – is restricted. Where your deed line ends and the takeline begins is a survey question, and the answer is usually farther up the slope than owners expect.
Constant moisture and wind. Fence near open water lives in a wetter, windier environment than the same fence a mile inland. Coating quality matters more and so does hardware, since fasteners corrode faster near water.
Building Iron That Survives Down There
- Keep the bottom rail clear of grade so the metal isn't sitting in standing water and silt
- Galvanize or properly prep and coat, especially the bottom eight inches, and expect that section to need attention before the rest does
- Set posts for the load, since a fence in a flow path takes lateral force a yard fence never sees
- Design for debris removal. A fence you can rake out after a storm stays a fence. One that packs solid becomes an obstruction.
- Don't run it across the floodway at all
